1. Acceptance of these terms
By creating a VIBESXS account, or by using VIBESXS as a guest, you agree to these Terms of Service. If you don’t agree, please don’t use the platform.
2. What VIBESXS is
VIBESXS is a mood-based music streaming platform. Guests and registered listeners can play music matched to a mood or listening context, build a personal listening history, use mood-driven tools like the Autonomous DJ and ISO Journey, and optionally connect compatible smart lighting to react to what’s playing. Artists and labels can upload and manage music through a separate, invite-based contributor system.
3. Accounts
Creating an account requires a valid, real email address you control — sign-in is passwordless, using a one-time code sent to that address each time. You’re responsible for keeping access to that email address secure; anyone who can read a code sent to it can sign in as you. You must be old enough, under the laws of where you live, to agree to these terms on your own.
You can change the email address on your account or permanently delete your account at any time from the Your Vibe page, both confirmed with a one-time code, without needing to contact us.
4. Age and family use
VIBESXS is made for a family audience. You must be at least 13 years old to create an account and use the service on your own. We do not knowingly collect personal information from anyone under 13; if you believe a child under 13 has an account, please contact us and we will remove it. If you are under the age of majority where you live, please read these Terms and our Privacy Policy with a parent or guardian. Shared features such as leaderboards never show your name, email or username, only a generated alias, and you decide whether to appear.
5. Guest access and account tiers
VIBESXS can be used without an account, at a smaller daily play allotment than a registered Free account gets. Free, Premium, and Elite tiers each come with their own play allotment, described on the sign-up page; allotments and their reset cadence may change, including as part of a promotion, and the current numbers shown on that page are the operative ones at any given time.
Listening on VIBESXS is streaming-only: a play happens live during an active session, and no track can be downloaded, saved offline, or exported as part of a listening plan. The play allotment described above measures streaming plays, not a personal music library — reaching your limit doesn’t mean you’ve “used up” a set of songs you now own, only that you’ll need to wait for the next reset or move to a tier with a larger allotment.
6. Acceptable use
You agree not to:
- Circumvent, or attempt to circumvent, play allotments, account suspensions, or any other access control on the platform, including by creating additional accounts to replace one that’s been suspended;
- Use automated tools to create accounts, scrape the platform, or generate artificial plays, favorites, or referrals;
- Interfere with the platform’s operation, security, or other users’ access to it;
- Use the platform for anything unlawful, or upload/share anything you don’t have the rights to.
An account found violating these terms may be suspended without notice. A suspended account can’t sign in or play music until it’s reactivated; suspension doesn’t itself delete your account or its data.
7. Contributor content (artists and labels)
If you’re an approved contributor uploading music, you confirm you own or are authorized to distribute everything you upload, and you grant VIBESXS the rights necessary to stream, analyze, and display that content on the platform for as long as it remains listed. You remain the owner of your own work.
VIBESXS may, in the future, let contributors download their own uploaded tracks solely to verify what’s live on the platform — not to redistribute, license, or otherwise share the file elsewhere. This capability isn’t available today; if and when it launches, it will remain limited to a contributor’s own catalogue and to verification purposes only, and won’t extend to listeners or to any other tier.
8. Rewards and referrals
Contributors may be eligible for a rewards program tied to genuine listener engagement and referrals, described in more detail elsewhere on the platform. Accounts or activity that appear designed to game the program (rather than reflect genuine listening or genuine referrals) may be flagged, frozen, or reversed, at our discretion.
9. Smart lighting integration
If you connect a compatible lighting device, VIBESXS sends it mood and playback data to drive lighting effects. You’re responsible for your own device and its configuration; VIBESXS isn’t responsible for how a third-party device behaves.
10. Party Pass, Vibe Space, and hosted listening
Party Pass and Space Pass let a host use VIBESXS’s own apps — including the Autonomous DJ and the Vibe Party Room, or a Vibe Space — to provide music for guests at a gathering, whether in person, virtual, or both. All music played through a Party Pass or Space Pass session comes exclusively from the VIBESXS catalogue. As long as you and your guests are listening through VIBESXS’s own apps, no additional public-performance or streaming license is required from you as host for that music — that coverage is between VIBESXS and its catalogue, not something you need to separately arrange.
VIBESXS does not provide access to, and has no arrangement with, any external music service (including, for example, Spotify, Apple Music, SoundCloud, YouTube, or a personal music library). Playing or routing music from any source other than the VIBESXS catalogue during a Party Pass or Space Pass session — including through the same room, device, or sound system — is strictly forbidden by this policy, regardless of whether that other source is separately licensed to you personally. This is in addition to, not instead of, the restriction in Section 4 against downloading, saving, or exporting VIBESXS music itself.
As the host of a Vibe Space, you’re responsible for what you play and say while broadcasting to your room — the same standard that applies to anything else you post or upload on VIBESXS. Only the host can publish audio (mic or mix) to a Vibe Space; listeners cannot. If a room is used to broadcast content that violates these Terms, VIBESXS may end the session and take the same account-level action described elsewhere in these Terms.
VIBESXS does not record or save Vibe Space sessions — the music, mixes, or mic broadcasts — by default. Nothing said or played in a Vibe Space is stored by VIBESXS unless a future recording feature says otherwise, at which point this policy will be updated and hosts/listeners will be told before it applies to their room.
VIBESXS Space Passes (hourly or flat-rate) are sold as flat, one-time purchases. They are non-refundable once purchased, except at VIBESXS’s discretion for a verified platform-side outage. Scheduling or rescheduling a Space Pass session before it goes live does not use up the pass; once you go live, the pass is redeemed and the purchase is final regardless of how much of the scheduled time is actually used.
When you schedule a Vibe Space with a Space Pass, VIBESXS gives you a single shareable link for that session. You are solely responsible for deciding who you share that link with and how widely you distribute it. If you set your Vibe Space to allow public joining, anyone who has the link can join without your approval. VIBESXS is not responsible for guests who join using a link you shared, however it was shared, or for any consequence of how widely that link circulates once it leaves your hands.
11. Changes, disclaimers, and liability
VIBESXS is provided as-is, without warranties of any kind. We may change, suspend, or discontinue any part of the platform at any time. To the fullest extent the law allows, VIBESXS isn’t liable for indirect or consequential damages arising from your use of the platform.
We may update these terms as the platform changes; continuing to use VIBESXS after an update means you accept the revised terms.
